As performance-based compliance becomes increasingly prevalent across the built environment, understanding how to effectively develop, assess and manage Performance Solutions is essential for industry professionals.
This webinar provides a practical and critical examination of Performance Solutions under the National Construction Code (NCC), exploring both the regulatory framework and the real-world application of performance-based compliance pathways. Participants will gain insight into the evolution from traditional Deemed-to-Satisfy provisions to performance-based legislation, including the legal concepts of hard and soft law, negotiated compliance, regulatory effectiveness, risk management, and the growing reliance on professional judgement.
The session will guide attendees through the practical management of Performance Solutions, including identifying when a Performance Solution is required, mapping Performance Requirements, selecting appropriate Assessment Methods, and assembling suitable evidence to demonstrate compliance. Real-world examples covering external wall systems, combustible cladding, weatherproofing, structural performance and thermal performance will illustrate key concepts and common challenges.
The webinar will also examine the Performance-Based Design Brief (PBDB) process, stakeholder responsibilities, documentation standards, evidentiary requirements, and the importance of maintaining independence and managing conflicts of interest.

Dr O’Brien is Chair of the Graduate Diploma of Building Surveying and lecturer in building surveying at Victoria university. Darryl also acts as a private building consultant based in Qld and as a subject matter expert for select government departments. Prior to this, Darryl was Director of Technical and Regulation at the Victorian Building Authority and was a built environment lecturer and Head of Course for CQUniversity.
Darryl is author of the textbook ‘Principles of Performance-Based Legislation’ published by Lexis Nexus NSW.
Darryl is a Fellow of the Australian Institute of Building Surveyors and past QLD NT Vice President, former member of the AIBS QLD State Executive Committee, AIBS National Technical Committee and AIBS Education Specialist Advisory Group.
